TERMS AND CONDITIONS

THE CHILD AND ADOLESCENT FOUNDATION INDIA (hereinafter referred to as “CAAF INDIA” in the following document.)

Please read these Terms of Use (“TOU”) prior to registering for an account on caafindia.org or using any portion of the CAAF INDIA website or mobile applications (collectively, the “CAAF INDIA Site” which consists of all content and pages located within the caafindia.org web domain and all CAAF INDIA mobile applications), including accessing any course material, chat rooms, or other electronic services.

These TOU that follows are agreements (the “Agreements”) between you and Child And Adolescent Foundation India (CAAF INDIA). By using the “CAAF INDIA Site”, you accept and agree to be legally bound by the Agreements, whether or not you are a registered user.

CAAF INDIA (CAAF INDIA) reserves the right to modify these TOU at any time without advance notice. Any changes to these TOU will be effective immediately upon posting on this page, with an updated effective date. By accessing the “CAAF INDIA Site” after any changes have been made, you signify your agreement on a prospective basis to the modified TOU and all of the changes. Be sure to return to this page periodically to ensure familiarity with the most current version of these TOU.

CAAF INDIA’s mission is to enrich the lives of children, adolescents, and their stakeholders through learning, training, care, and support. We empower individuals from diverse backgrounds to create and share educational content (educators), as well as access such content for learning purposes (students), while prioritizing their well-being and providing support in this platform. We believe that our marketplace model is the most effective approach to provide valuable educational resources to our community. To ensure the safety and well-being of our users, as well as the integrity of our platform and services, we have established guidelines. These Terms govern all interactions and engagements with CAAF INDIA’s website, mobile applications, TV applications, APIs, and other associated services (“Services”).

By utilizing our platform and applications, you acknowledge and consent to the transmission of communications regarding your browsing, app activities, and app usage to third-party service providers who assist CAAF INDIA in delivering our services.

1. Rules for Online Conduct

You agree that you are responsible for your own use of the CAAF INDIA site and for your User Postings. “User Postings” means all content submitted, posted, published, or distributed on the CAAF INDIA site by you or other users of the CAAF INDIA site, including but not limited to all forum posts, wiki edits, notes, questions, comments, videos, and file uploads. You agree that you will use the CAAF INDIA site in compliance with these Agreements, and all applicable local, state, national and international laws, rules and regulations, including copyright laws, any laws regarding the transmission of technical data exported from your country of residence, and all Indian laws governing the matter.

As a condition of your use of the CAAF INDIA site, you will not use the CAAF INDIA site in any manner intended to damage, disable, overburden, or impair any CAAF INDIA server or the network(s) connected to any CAAF INDIA server or to interfere with any other party’s use and enjoyment of the CAAF INDIA site. You may not attempt to gain unauthorized access to the CAAF INDIA site, other accounts, computer systems, or networks connected to any CAAF INDIA server through hacking, password mining, or any other means. You may not obtain or attempt to obtain any materials or information stored on the CAAF INDIA site, its servers, or associated computers through any means not intentionally made available through the CAAF INDIA site. If you are a registered user, you will not share your password or let anyone else access or compromise your account.

Furthermore, you agree not to scrape, or otherwise download in bulk, any CAAF INDIA site content, including but not limited to a list or directory of users on the system, User Postings or user information, online textbooks, course materials, or trademarks and logos. You agree not to misrepresent or attempt to misrepresent your identity while using the CAAF INDIA site (although you are welcome and encouraged to use an anonymous username in the forums and to act in a manner that keeps your identity concealed).

If the user does not access the site for more than 90 days, the login registration gets cancelled.

2. Strictly Prohibited Items

The following items are strictly prohibited on the CAAF India site:

a. content that defames, harasses, or threatens others.

b. content that discusses illegal activities with the intent to commit them;

c. content that infringes another’s intellectual property, including, but not limited to, copyrights or trademarks;

d. profane, pornographic, obscene, indecent or unlawful content;

e. advertising or any form of commercial solicitation;

f. content related to partisan political activities;

g. viruses, trojan horses, worms, time bombs, corrupted files, malware, spyware, or any other similar software that may damage the operation of another’s computer or property.

h. content that contains intentionally inaccurate information or that is posted with the intent of misleading others (this list, collectively, “Strictly Prohibited Items”).

i. you may not submit, post, publish, share, or otherwise distribute any of the above Strictly Prohibited Items on or via the CAAF INDIA site.

3. User Accounts

In order to create a user account with CAAF INDIA, you may need to provide your full name and an email address. By creating an account, you agree never to disclose or share access information for your user account with any third party for any reason. You may also be prompted to enter additional optional information, such as your age group or current role, when accessing specific courses within the portal. You certify that all information provided by you is accurate and up-to-date, and you agree to maintain and update this information as necessary.

We may gather personally identifiable information from you during various interactions, such as browsing the Site, booking a session, communicating with us via phone, email, or chat, participating in contests, promotions, or surveys, or attending our sessions, workshops, events, etc. Through these activities, you may provide us with Personal Information, including but not limited to your name, email and postal addresses, phone numbers, credit card/banking details, shipping information for purchases, IP addresses, product interests, and, in some cases, your opinions and preferences (collectively referred to as “Personal Information”). Additionally, our Site, social media platforms, or mobile applications may automatically collect certain information about your device or usage through technologies like cookies, web server logs, and web beacons. We prioritize the confidentiality and security of your personal information.

You require an account for most activities on our platform, including purchasing and accessing content or submitting content for publication. When setting up and managing your account, you must provide and ensure the accuracy and completeness of all information, including a valid email address. You are solely responsible for your account and any actions taken on it, including any harm or damage caused by unauthorized use. It is imperative to safeguard your password, and you may not transfer your account to or use someone else’s account.

Should you suspect unauthorized access to your account or any security breach, you must notify us immediately by contacting our Support Team. We may request additional information to confirm your account ownership.

Both students and instructors must be at least 18 years old to create an account on CAAF INDIA and  utilize the services. If you are younger than 18 but meet the legal age for consent to use online services in your jurisdiction, we encourage you to have a parent or guardian create an account to access suitable content on your behalf. Accounts created in violation of these age requirements will be terminated.

You have the option to terminate your account at any time but the fees collected will never be refunded.

4.Your Right to Use Content on the CAAF INDIA Site

Unless explicitly stated as being in the public domain, the content on the CAAF INDIA site is protected by Indian and foreign copyright laws. The texts, exams, videos, images, and other instructional materials provided with the courses and programs offered on the CAAF INDIA site are for your personal use solely in connection with those courses and programs, unless otherwise expressly stated. Some reference documents, digital textbooks, articles, and other information on the CAAF INDIA site are used with the permission of third parties, and usage of such information is subject to specific rules and conditions, which will be made available alongside the information. By accessing the CAAF INDIA site, you agree to adhere to all such rules and conditions and retain all copyright and other notices on any content obtained from the site. All rights in the CAAF INDIA site and its content, if not explicitly granted, are reserved.

5.Use for Personalization and Pedagogical Improvements

Our aim is to offer the best possible educational and well-being experience to current and future visitors of the CAAF INDIA site. To achieve this, we may occasionally present different users with varying versions of course materials and software. This is done to personalize the experience for individual learners, assess their level of ability and learning style, and provide materials best suited to their needs. Additionally, this helps us enhance our understanding of the learning process and evaluate and improve the effectiveness of our course materials, payment models, platform features, and offerings. Any results obtained from this process may be published or publicized; however, unless otherwise permitted under the Privacy Policy, such publications or disclosures will not include your personal information.

6. User Postings Representations and Warranties

By submitting or distributing your User Postings, you affirm, represent, and warrant that you have the necessary rights, licenses, consents, and/or permissions to reproduce and publish the User Postings. Additionally, you affirm that you have the authority to authorize CAAF INDIA and its users to reproduce, modify, publish, and otherwise use and distribute your User Postings in a manner consistent with the licenses granted below. Furthermore, you warrant that neither your submission of your User Postings nor the exercise of the licenses granted below will infringe or violate the rights of any third party. You acknowledge that you, and not CAAF INDIA, are solely responsible for your User Postings and the consequences of posting or publishing them.

7. License Grant to CAAF INDIA

By submitting or distributing your User Postings, you hereby grant to CAAF INDIA a worldwide, non-exclusive, transferable, assignable, sublicensable, fully paid-up, royalty-free, perpetual, irrevocable right and license to host, transfer, display, perform, reproduce, modify, distribute, redistribute, relicense, and otherwise use, make available, and exploit your User Postings, in whole or in part, in any form and in any media formats and through any media channels (now known or hereafter developed). Additionally, by agreeing to the Terms of Use, you also consent to provide course instructors from these member institutions access to the data generated by you.

8. Ownership of Content

Any content, including courses, posted by students or instructors on the CAAF INDIA platform remains under the ownership of CAAF INDIA. However, proper credit will be attributed to the student or instructor. All content posted on the site is exclusively the property of CAAF INDIA.

9. Authorization for Use of Content

When you post content, comments, questions, reviews, or submit ideas and suggestions for new features or improvements, you authorize CAAF INDIA to use and share this content with anyone, distribute it, and promote it on any platform and in any media. CAAF INDIA may also make modifications or edits to your content as deemed necessary.

When accessing or using the Interactive Sessions, you are prohibited from:

a. using the Interactive Sessions for any purpose other than the activities instructed by CAAF INDIA’s labs.

b. providing web, database, or forum access, or engaging in cryptocurrency mining through the Interactive Sessions.

c. exceeding the usage limitations outlined on our Support Page.

d. accessing or using the Interactive Sessions in any commercial production environment.

e. taking any action in the Interactive Sessions that disrupts or interferes with our Services or the stability of our infrastructure.

f. using any data or information other than simulated, anonymous, non-personal, non-live data or information when accessing or using the Interactive Sessions.

10. Using CAAF INDIA at Your Own Risk

Anyone can use CAAF INDIA to create and publish content, and we enable instructors and students to interact for teaching and learning and well-being programs. However, like other platforms where people can post content and interact, there are inherent risks involved, and you use CAAF INDIA at your own risk.

Our platform model means we do not review or edit content for legal issues, and we are not in a position to determine the legality of content. We do not exercise editorial control over the content available on the platform and do not guarantee the reliability, validity, accuracy, or truthfulness of the content. If you access content, you do so at your own risk.

By using the Services, you may encounter content that you find offensive, indecent, or objectionable. CAAF INDIA has no responsibility to prevent access to such content, and we have no liability for your access or enrolment in any course or other content, to the extent permissible under applicable law. This also applies to content relating to health, wellness, and physical exercise. You acknowledge the inherent risks in accessing such content and choose to assume those risks voluntarily, including the risk of illness, bodily injury, disability, or death. You assume full responsibility for the choices you make before, during, and after accessing the content.

When interacting directly with other users, such as students or instructors, you must be cautious about sharing personal information. While we restrict the types of information instructors may request from students, we do not control how users handle the information obtained from others on the platform. You should refrain from sharing email addresses or other personal information for your safety.

We do not employ instructors, nor are we responsible or liable for any interactions between instructors and students. CAAF INDIA is not liable for disputes, claims, losses, injuries, or damages arising from or related to the conduct of instructors or students.

When using our Services, you may encounter links to third-party websites that we do not own or control. We are not responsible for the content or any other aspect of these third-party sites, including their collection of information about you. You should review their terms and conditions and privacy policies.

11. CAAF INDIA’s Rights 

We own the CAAF INDIA platform and services, including the website, present or future apps and services, and items such as our logos, API, code, and content created by our employees. You may not tamper with or use these without authorization.

Right, title, and interest in and to the CAAF INDIA platform and Services, including our website, applications, APIs, databases, and content provided by our employees or partners through our Services, are and will remain the exclusive property of CAAF INDIA and its licensors. Our platforms and services are protected by copyright, trademark, and other laws. You have no right to use the CAAF INDIA name or any of its trademarks, logos, domain names, or other distinctive brand features. Any feedback, comments, or suggestions you provide regarding CAAF INDIA or the Services is voluntary, and we are free to use it without obligation to you. While users retain ownership of the content, they post on CAAF INDIA, they grant the platform certain rights to utilize and share that content. By posting content, users authorize CAAF INDIA to use, modify, and distribute it for promotional and educational purposes. Users represent that they possess the necessary rights and permissions to grant this authorization.

While accessing or using the CAAF INDIA platform and Services, you may not:

a. access non-public areas of the platform or our computer systems without authorization.

b. disable or interfere with security features of the platform.

c. copy, modify, or create derivative works of our platform or content.

d. access or search our platform by any means other than through our available search functionalities.

e. use automated means to access the Services.

f. send altered or deceptive information using our Services.

g. interfere with the access of any user, host, or network.

We reserve the right to enforce these terms to the fullest extent of the law

 12. Content Enrollment, Usage Guidelines, Conduct Policies and Responsibilities

When you enroll in content on CAAF INDIA, you’re permitted to access and view it exclusively through our platform. This access is granted solely for personal learning purposes, and any attempt to transfer or resell content is strictly prohibited. In most cases, users enjoy period/duration mentioned during registration to access the enrolled content, unless exceptional circumstances outlined in our policies require its removal. Users of CAAF INDIA must adhere to strict guidelines regarding content creation and conduct. All posted content must comply with applicable laws and our Trust & Safety Guidelines. It is the user’s responsibility to ensure that any content they post, including comments, questions, reviews, or courses, aligns with legal requirements and respects the intellectual property rights of others. Failure to comply with these standards may result in the removal of content or the suspension of user accounts. Users engaging with CAAF INDIA are required to conduct themselves in accordance with local and national laws and regulations. Whether acting as a student or an instructor, users must uphold legal standards and respect the rights of others. It’s imperative that users understand and comply with copyright laws when posting content on the platform. CAAF INDIA reserves the right to take appropriate action, including content removal, in response to violations of laws or platform guidelines.

13. Disclaimers of Warranty / Limitations of Liabilities

CAAF INDIA provides its platform and content on an “as is” basis, with no guarantee of uninterrupted or error-free service. Users access content at their own risk, and CAAF INDIA disclaims liability for any damages incurred, except were prohibited by law. Users are advised to review the terms of service carefully and understand their rights and responsibilities before accessing content on the platform.CAAF INDIA does not assume responsibility for the accuracy or reliability of user-generated content posted on the platform. While efforts are made to moderate content and remove inappropriate postings, users acknowledge that they may be exposed to objectionable material. By using the platform, users waive any legal claims against CAAF INDIA related to user-generated content. The platform reserves the right to moderate content as deemed necessary to maintain a safe and respectful learning environment.

14.Intellectual Property Rights

      a. Trademarks and Copy Rights

Use of trademarks such as “CAAF INDIA,” is strictly regulated. These trademarks are owned by their respective entities and may not be used without prior written consent. Any use of these trademarks must not imply affiliation or endorsement without explicit permission. Trademarks not owned by CAAF INDIA or its Members but appearing on the platform are the property of their respective owners.

The “CAAF INDIA” name, logo, and all associated product and service names, design marks, and slogans (hereinafter referred to as “Marks”) are the trademarks, logos, or service marks of CAAF INDIA.  All other Marks provided on the Site belong to their respective companies. No license for the use of any trademark or service mark is granted in connection with the materials found on this Site. Accessing this Site does not grant anyone the authorization to use any Marks in any manner. Marks displayed on this Site, whether registered or unregistered, of CAAF INDIA or others, are the intellectual property of their respective owners, and CAAF INDIA shall not be held liable for any unlawful, unauthorized use of the Marks.

CAAF INDIA, along with its suppliers and licensors, expressly reserve all intellectual property rights to all materials, including images, text, illustrations, designs, icons, photographs, programs, music clips, downloads, video clips, written content, programs, products, processes, technology, that are part of this Site (collectively, the “Contents”), including its look and feel, unless otherwise credited. The compilation (referring to the collection, arrangement, and assembly) of the content on the Site is the exclusive property of CAAF INDIA and is protected by Indian Copyright laws and international treaties. 15. Certificates and Other Products & Services

15.1 General

CAAF INDIA, along with participating colleges, universities, and institutions, Organization and Individual collaborators (“Members”), may offer various services and products for a fee on the CAAF INDIA platform, such as course certificates. By making a purchase on CAAF INDIA, you agree to pay all applicable fees promptly. Payment processing is handled by a third-party vendor, ensuring secure transactions. Upon completing a payment, you’ll receive a confirmation email containing essential details for your records, which may be necessary for refund requests based on refund terms.

15.2 No Other Enrollment

Enrolling in or completing a course or program on CAAF INDIA does not imply admission to any degree or credit-bearing program offered by a member institution. Users are not granted access to additional resources beyond the online courses provided on the platform, nor are they eligible for student privileges or benefits associated with degree programs.

15.3 Well-being Services

 Well-being services involve a relationship where both parties have rights and responsibilities. As a client, you have the right to understand these and the therapist has responsibilities toward you. While therapy can bring about benefits like improved relationships and greater self-awareness, it may also evoke uncomfortable feelings. The initial sessions will involve evaluating your needs and discussing treatment goals. You have the right to ask questions and seek a second opinion if needed.

a. Risks And Benefits

Therapy may bring up difficult emotions but can lead to long-lasting benefits such as improved relationships and problem-solving skills. While we aim for these outcomes, we cannot guarantee them.

b. Client-Therapist Relationship

Our relationship is solely professional, focused on your needs. Your therapist will avoid social or business relationships with you and will not accept gifts or engage in service exchanges.

c. Parental Guidance

Parental guidance is mandatory when addressing children below 18 years, and CAAF INDIA representatives will not engage in individual sessions with children.

d. Client Rights

As a client, you have the right to:

    a. be treated with respect and dignity. 

    b. receive quality treatment regardless of background.

    c. confidentiality in your treatment.

    d. be involved in your treatment planning and aftercare.

    e. refuse treatment and understand its consequences.

    f. expect continuity of care.

    g. voice concerns and end therapy if needed.

    h. receive information about your therapist’s qualifications and maintain a professional relationship.

e.Appointments And Cancellations

Sessions last an hour, and timely attendance is crucial. You can cancel or reschedule appointments, but cancellations with less than 24 hours’ notice may incur charges. We do not accept insurance.

f. Communication

We may contact you via email, phone, SMS, WhatsApp, or other channels for appointment reminders and additional care. By agreeing to our terms, you allow us to reach out through these channels.

g. Professional Records

Your therapist may keep records of your treatment, which are securely maintained.

h. Consent to Well- Being Programs

By agreeing to the Terms and Conditions, you confirm that you understand and accept the terms outlined in this form. You acknowledge that you have had the opportunity to ask questions and seek clarification on any unclear points. You willingly consent to receive well-being assessment, psychoeducation and services for yourself or your child, and you have the right to discontinue treatment or services at any time.

CAAF INDIA – E-CAAFI serves as a well-being forum, dedicated to providing psychological education, counseling, and support for overall well-being. It’s crucial to understand that while our platform offers valuable resources and guidance, it should never replace medical treatment provided by qualified professionals. The advice and information provided by experts on our website are intended for informational purposes only and cannot substitute a thorough examination by a doctor or mental health professional. Users are strongly advised against solely relying on, or basing decisions solely on the advice provided by any expert.

Although our experts may include counselors, therapists, or other mental health professionals, CAAF INDIA – E-CAAFI explicitly disclaims any liability for consultations and therapy services rendered through the website. Users must acknowledge and assume full responsibility for their decision to access an expert through our platform and continue interacting with them. Our role is strictly limited to providing access to these experts.

It’s important to note that our services are not suitable for emergencies. If you believe you have a medical or mental health emergency or are concerned about your care, please seek assistance from the nearest hospital or healthcare provider immediately. Additionally, while we provide support for various mental health challenges, we are not a suicide helpline platform. Individuals experiencing suicidal thoughts or feeling endangered should cease using our services and contact appropriate emergency services or a suicide prevention helpline promptly.

It is not permitted for minors under the age of eighteen to use this service without adult supervision.

Ultimately, users understand and accept that their use of our website and services is entirely at their own risk. CAAF INDIA – E-CAAFI does not engage in the practice of medicine or provide medical care in any manner.

15.4 Manufacturing

CAAF INDIA aims for accuracy in product descriptions on the site but does not guarantee absolute accuracy, completeness, or reliability. There may be typographical errors or inaccuracies, and product images provided are indicative and may not precisely match the actual product. We reserve the right to correct errors, update information, or make changes without prior notice, even after an order has been placed. Please note that errors may relate to pricing and product availability. Products and services offered on these sites are intended for personal or professional use only and should not be resold for commercial purposes. If any products or healthcare services purchased or received cause side effects or discomfort, CAAF INDIA holds no responsibility. It is advisable to read the terms and conditions and consult a specialist before use.

    a. Products

Our products are handmade by marginalized individuals, especially abled, women entrepreneurs to support and empower while slight variations may occur, the quality remains consistent.

    b. Delivery

Once your order is processed, it undergoes thorough inspection to ensure quality. After passing inspection, it is packed and handed over to our trusted delivery partner. Our delivery partners strive to deliver your package promptly. In case of any issues, they will contact you to resolve them.For international shipping, clients are responsible for paying import duties levied by their government and customs duty to the courier provider.

    c. Packaging

We use low-waste packaging, including reusable glass jars, cloth scraps, and recycled paper. Our aim is to minimize environmental impact, and we encourage customers to reuse and recycle packaging materials.

    d. Shipping Locations

CAAF INDIA ships throughout India and is expanding to more countries.

    e. Tracking

After dispatch, you will receive an email with tracking details. You can track your package 24 hours after dispatch.

    f. Delivery Time

Most orders are dispatched within 7 business days. Some products may require creation post-order to accommodate customizations or provide updated contents. While we strive to avoid delays, international orders may experience delays due to logistics or holidays.During sale events, dispatches may be delayed due to increased volumes.

 

16. Payments

You agree to pay the fees for content that you purchase, and you authorize CAAF INDIA to charge your debit or credit card or process other means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. CAAF INDIA works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information secure. We may update your payment methods using information provided by our payment service providers. Check out our Privacy Policy for more details. When you make a purchase, you agree not to use an invalid or unauthorized payment method. We reserve the right to disable access to any content for which we have not received adequate payment.

a. Shipping

   a. Standard shipping charges apply for most addresses.

   b. For India, a flat rate of Rs. 50 is charged for orders below Rs. 1,000, with free shipping for orders above Rs. 1,000.

   c. For international orders, a flat rate of Rs. 600 applies for orders below Rs. 5,000, with free shipping for orders above Rs. 5,000.

   d. COD payments are not accepted.

No refund is available for online courses. We want to ensure your satisfaction, and as such, we offer refunds for eligible purchases made on our platform. However, please note that course registration fees are non-refundable, as they are considered registration fees. For payments made via credit/debit cards or net banking, the refund will be processed to the same account within 7 business days after we receive the products back. It may take an additional 2-3 business days for the amount to reflect in your account. If you’ve used Discount Vouchers, Gift Cards, or Coupons, please note that they are intended for one-time use only and will be considered used even if you cancel the order. Loyalty points redeemed for an order will be credited back to your account in case of cancellation.

“CAAF INDIA or our partners may offer gift and promotional codes to students. Certain codes may be redeemed for gift or promotional credits applied to your CAAF INDIA account, which then may be used to purchase eligible content on our platform, subject to the terms included with your codes. Other codes may be directly redeemable for specific content. Gift and promotional credits can’t be used for purchases in our mobile or TV applications. These codes and credits, as well as any promotional value linked to them, may expire if not used within the period specified in your CAAF INDIA account. Gift and promotional codes offered by CAAF INDIA may not be refunded for cash, unless otherwise specified in the terms included with your codes or as required by applicable law. Gift and promotional codes offered by a partner are subject to that partner’s refund policies. If you have multiple saved credit amounts, CAAF INDIA may determine which of your credits to apply to your purchase.”

e. Returns, Replacements, and Refunds

We strive for quality, but if our product is damaged during shipment or transit, you can request a replacement or refund. Our ‘Easy Return Policy’ allows you to raise a return/exchange request within 5 days of delivery. Partial returns are also accepted.Please email our Customer Support team at info@caafindia.org within 5 business days of receiving the order, providing your order ID details and the reason for return/replace/refund along with images of the product and the invoice.

We’ll arrange for product pickup within 2-4 business days. Refunds or replacements will be initiated only if the products are returned in their original packaging with seals, labels, and barcodes intact. Returns are accepted for products received in a damaged/defective state or if an incorrect product has been delivered. The returned products must be unused and sealed. Returns will not be accepted for used or altered products. If a return is accepted, we’ll refund or replace the invoiced amount for the damaged/defective/wrong product, excluding additional customs/shipping charges paid by the customer. Please note that replacements are subject to stock availability, and if unavailable, we’ll issue a full refund. Free gifts included with the order must also be returned along with the original product.

Returns will not be accepted under certain conditions, such as misuse/overuse of the product, damaged packaging, tampered serial numbers, or if the request is initiated after 5 business days of order delivery. Personal care appliances cannot be returned due to hygiene issues.

17.  Additional Terms

a. Termination Rights; Discontinuation of Courses and Content

You agree that CAAF INDIA, in its sole discretion, may terminate your use of the CAAF INDIA Site or your participation in it, for any reason or no reason, upon notice to you. It is CAAF INDIA’s policy to terminate in appropriate circumstances the accounts of users of the CAAF INDIA site who are repeat copyright infringers. CAAF INDIA reserve the right at any time in their sole discretion to cancel, delay, reschedule or alter the format of any course offered through CAAF INDIA, or to cease providing any part or all of the CAAF INDIA site content or related services. If you no longer desire to participate in the CAAF INDIA site, you may terminate your participation at any time. No refund will be provided. The rights granted to you hereunder will terminate upon any termination of your right to use the CAAF INDIA site, but the other provisions of the Agreements will survive any such termination.

b. Entire Agreement

The Agreements constitute the entire agreement between you and CAAF INDIA  with respect to your use of the CAAF INDIA site, superseding any prior agreements between you and CAAF INDIA regarding your use of the CAAF INDIA site.

c. Waiver and Severability

The failure of CAAF INDIA to exercise or enforce any right or provision of the Agreements shall not constitute a waiver of such right or provision. If any provision of the Agreements is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision and the other provisions of the Agreements shall remain in full force and effect.

d. Choice of Law/Forum Selection

You agree that the Agreements and any claim or dispute arising out of or relating to the Agreements or any content or service obtained from or through the CAAF INDIA site will be governed by the relevant and applicable laws in India, excluding its conflicts of law provisions. You agree that all such claims and disputes will be heard and resolved exclusively in the state high court located in and serving Chennai, Tamil Nadu, India. You consent to the personal jurisdiction of those courts over you for this purpose, and you waive and agree not to assert any objection to such proceedings in those courts (including any defense or objection of lack of proper jurisdiction or venue or inconvenience of forum).

Shipping Policy

Shipping

   a. Standard shipping charges apply for most addresses.

   b. For India, a flat rate of Rs. 50 is charged for orders below Rs. 1,000, with free shipping for orders above Rs. 1,000.

   c. For international orders, a flat rate of Rs. 600 applies for orders below Rs. 5,000, with free shipping for orders above Rs. 5,000.

   d. COD payments are not accepted.

Payments

You agree to pay the fees for content that you purchase, and you authorize CAAF INDIA to charge your debit or credit card or process other means of payment (such as Boleto, SEPA, direct debit, or mobile wallet) for those fees. CAAF INDIA works with payment service providers to offer you the most convenient payment methods in your country and to keep your payment information secure.
